THE Supreme Court has refused to hear a Texas lawsuit claiming voter fraud, effectively ending President Donald Trump’s bid to overturn the 2020 election result through the nation’s highest court.
The case, which had formal backing from at least 19 other States, was filed on December 8 claiming Georgia, Pennsylvania, Michigan and Wisconsin had conducted unconstitutional presidential elections.
Texas claimed this had effectively diluted the value of its citizens’ votes.
STANDING
The US Supreme Court, however, while not ruling on the legality of the elections, determined 7-2 in a procedural ruling that Texas lacked standing to bring the suit.
“Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections,” the court wrote on December 11.
Only justices Samuel Alito and Clarence Thomas supported hearing the case.
This action by a majority of Supreme Court justices sends a signal the court would prefer not to rule on the highly contested presidential election.
President Trump, who had earlier described the case as the “big one”, stated on social media: “The Supreme Court really let us down. No Wisdom, No Courage!”
The President still refuses to concede, however, and continues to have a number of “legislative and State court” pathways to retaining office, according to US election commentators.
Pro-Republican social media commentator Dr Steve Turley said that, despite the Supreme Court ruling, “this is not over by a long shot”.
NEVER LOST
“We’ve had this massive surge in support for President Trump just in the past few days,” Dr Turley said.
“With the Texas lawsuit you saw upwards of 20 States join the case with amicus briefs, you had over 120 Republicans in the House align with it, Senator Ted Cruz offered to argue it before the Supreme Court – I believe he has a perfect record of arguing cases before the Supreme Court, he’s never lost.
“You have all the polls moving in our direction, with the American public doubting the integrity of the election to some significant degree.
“So you have all of this movement, all of this momentum and then wham, we get the Supreme Court rejection.”
Dr Turley said it was a clear rejection.
“With all that was happening, they didn’t even want to listen to it – they just shattered everything,” he said.
“But the devil is in the detail and in many respects we are winning.”
He said while the Supreme Court ruling was “a blow, a sting, a disappointment” it had not shattered the momentum that had built for Trump.
WEAKNESS
“In many respects the momentum is bigger today, right now, than it was before the Supreme Court decision,” Dr Turley said.
“The Trump team was ready for this ruling, they knew the Texas case had a procedural weakness.
“So Rudy [Giuliani] and the team have already begun filing a suit in every single one of those States on behalf of President Trump who clearly does have standing, who clearly was adversely affected by these State’s accused impropriety.
“At the same time you still have Sean Parnell and Mike Kelly’s case against Pennsylvania Supreme Court illegally changing Pennsylvania [election] law.
“Justice Sam Alito still has a stay on all ballots that were turned in after 8pm on November 3 in Pennsylvania.
“You have the Wisconsin Supreme Court in deliberation regarding the mega-tonne lawsuit that the Trump team dropped there and that actually looks very straight forward.
“In Wisconsin you can’t get a mail-in ballot unless you have a written request for one.
“During the 10-day recount in Wisconsin the Trump team identified 60,000+ ballots that had no record of a written request from the voter – by definition they all need to be tossed.
“And Biden has only a 19,000 vote ‘lead’ in Wisconsin.”
Dr Turley said Pennsylvania, Wisconsin and Georgia were the lowest hanging fruit.
DOMINION
“Georgia’s [Republican] legislature and governorship at least can, theoretically, appoint their own electors very easily.
“In addition, a Michigan court has granted the Trump team access to the Dominion voting system machines.
“So, all of this is to say that there is a massive amount of momentum still going on.
“While we’d loved to have had that momentum continue particularly in the Texas case, it was only one of a number of different cases going on contributing to this momentum.”
Republicans, he said, had now seen so much evidence of voter fraud that they are saying it’s time to stand with the President.PC
