A Biden-appointed federal judge has ordered the Trump administration to immediately pull three taxpayer-funded advertisements the left claims were created for “political or propaganda purposes,” including one in which President Donald Trump tells viewers every American will get $5,000 if Republicans keep control of Congress.
U.S. District Judge Jennifer L. Rochon, a Joe Biden appointee in the Southern District of New York, sided Friday with a coalition led by the left-wing “nonpartisan” group Common Cause, Courthouse News Service reported.
She ordered the government to take down the ads titled “$5,000 to Americans,” “Every Democrat Voted Against No Tax on Tips,” and “Cost of Socialism” from official government websites and social media accounts (YouTube, Instagram, and others).
She also ordered the cancellation of any plans to distribute the ads through third parties, including President Trump’s super PAC, MAGA Inc.
The order expands a temporary restraining order Rochon issued two weeks earlier that already blocked a series of television ads paid for with Department of Homeland Security funds.
As The Gateway Pundit previously reported, that earlier ruling came after progressive groups sued over ads the administration described as educational and unapologetically patriotic public service announcements reminding Americans why the country is worth defending.
In the “$5,000 to Americans” ad, Trump speaks from the Oval Office: “If the Democrats win, you will have an economic depression. If the Republicans win, you will each have $5,000 in your pocket.”
Rochon said she was “hard pressed” to see the message as anything other than a direct partisan call to support one party over another in the midterms. She called the three ads “purely partisan” pieces designed to attack Democrats and promote Republicans.
Rochon, who once clerked for Trump’s late sister, Judge Maryanne Trump Barry, declined to pull several other contested ads, saying the government was likely to prevail on those.
Plaintiffs had sought the removal of at least 13. She noted that the Government Accountability Office has recognized instances in which the president’s office may inform the public about policies, justify them, or respond to attacks.
White House spokesperson Lauren Bis responded bluntly: “This Biden-appointed activist judge issued a lawless order to stop the administration from sharing patriotic videos.”
President Trump previously said he would gladly pay for the ads himself and announced that MAGA Inc. would take over funding, describing them as “a positive promotion for our Great U.S.A.” rather than candidate advertising.
The earlier television campaign, which included spots highlighting the capture of Nicolás Maduro and Trump’s “Final Battle” messaging about demolishing the deep state and routing the fake news media, had already drawn roughly $19–20 million in DHS border-security-related funding before the prior court order.
Progressive plaintiffs and their lawyers at Democracy Forward celebrated the latest ruling as stopping “wanton disregard for the law.”
